Options for drawing up   a purchase and sale agreement

Without the participation of a notary

  1. The parties independently draw up a purchase and sale agreement that complies with the law. 
  2. After this, you need to contact the Department of Justice, whose specialist will check the documents and powers of the parties, and also certify the signatures of the seller and buyer.
  3. Next, you submit documents for registration to the PSC (Public Service Center).

It is important to know! Д To obtain the consent of the spouses of the buyer/seller for the purchase/sale of an apartment, you still need to contact a notary.

With the participation of a notary     

  1. The purchase and sale agreement is drawn up by a notary.
  2. The notary checks the seller’s authority to sell, certifies the signatures of the parties, formalizes the consent of the buyer/seller’s spouses to purchase/sell the apartment, and explains the meaning and consequences of the transaction.
  3. A purchase and sale agreement concluded with a notary requires registration in the PSC offices at the place of registration of real estate no later than six months after the transaction or on the website egov.kz

Before execution of the purchase and sale agreement

This method is not recommended, as it carries a high risk of losing money for the buyer. If you still decide to give the money right away, we recommend that you draw up a deposit agreement.

During the purchase and sale

After signing the agreement and certifying the signatures by a notary, the buyer transfers the money to the seller, the seller gives the buyer a purchase and sale agreement for its further registration in the Public Service Center.

After execution of the purchase and sale agreement

This option is usually used if the buyer does not have the full amount, and the contract specifies in what order and within what time frame he must pay the remaining balance to the seller. Here the risks are borne by the seller who re-registers the apartment without receiving the full amount. Therefore, it is important to secure all payment terms in the contract, so that you can then go to court and recover money in court.
