How to get a land plot for free
According to Article 50 of the Code, land plots, with the exception of those included in the list of land plots offered for sale at auctions (tenders, auctions) in accordance with paragraph 1 of Article 48 of this Code, are provided to citizens of the Republic of Kazakhstan free of charge to private ownership in the following amounts:

for personal subsidiary farming (including household and field plots) in rural areas - 0.25 hectares on non-irrigated and 0.15 hectares on irrigated lands;
for individual housing construction - 0.10 hectares;
for gardening, as well as cottage construction - 0.12 hectares.
Repeated free provision of land plots for these purposes is not allowed, except in the case specified in paragraph 4 of Article 94 of this Code.

The provision of land plots free of charge to private ownership for personal subsidiary farming (household allotment) and individual housing construction is carried out after the development of land plots. The provision of land plots for the specified purposes for the period of development is carried out on the right of temporary paid land use (lease) with the establishment of conditions and terms for the development of such land plots in accordance with Article 92 of this Code.

If there is free land on the territory of rural settlements, land plots for individual housing construction and personal subsidiary farming are provided as a single array within the norms of land plots provided for these purposes.

Land plots for gardening are provided to citizens of the Republic of Kazakhstan on the right of temporary gratuitous land use in the amount of no more than 1 hectare.

Obtaining a land plot from the state for free for individual housing construction
The Rules for granting rights to land plots for individual housing construction, approved by the Order of the Acting Minister of National Economy of the Republic of Kazakhstan dated March 27, 2015 No. 255 (hereinafter – the Rules) determine the procedure for granting land plots for individual housing construction to citizens of the Republic of Kazakhstan and oralmans in accordance with subparagraph 16-5) of paragraph 1 of Article 14 of the Land Code of the Republic of Kazakhstan.

According to paragraph 5 of these Rules, in order to obtain a land plot for individual housing construction, citizens of the Republic of Kazakhstan and oralmans submit an application in any form for the provision of a land plot for individual housing construction on the right of temporary paid land use (lease) (hereinafter – the application) at the location of the requested land plot:

within the boundaries of the city of republican significance and the capital – akimat of the city of republican significance and the capital;
within the boundaries of the city of regional significance – Akimat of the city of regional significance;
within the boundaries of the city of district significance – akimat of the city of district significance;
within the boundaries of the village – akim of the village;
within the boundaries of the village – akim of the village, rural district.
In accordance with paragraph 6 of the Rules, the application shall specify:

the purpose of using the land plot;

its estimated size;
location;
the requested right of use, the presence (absence) of another land plot previously provided by the state for individual housing construction on a free basis.
